(NYRA), one appointed by the New York State Gaming Commission, and one appointed by The Jockey Club (TJC) – provide an explanation of what happened and the reason for their decision. Race Decisions - September 5, 2011

RACE 8: Steward’s Inquiry and a Jockey’s Objection – J. Velazquez, the rider of # 7 Fiddlers Patriot, lodged a claim of foul against the second placed finisher,
# 5 Pashito the Che (C. Velasquez), for alleged interference in the stretch.  In the vicinity of the 1/8 pole, # 5 drifts out making contact with # 7 and again inside the 1/16 pole. causing # 7 to alter course.   # 7 Fiddlers Patriot finished fourth.
In the judgment of the Stewards, # 5 did impede # 7’s progress and altered the finish of the race.  # 5 Pashito the Che is disqualified from second and placed fourth.

The stewards may also take into consideration mitigating factors, such as whether the impeded horse was partly at fault or the crossing was wholly caused by the fault of some other horse or jockey.
(c) If a horse or jockey jostles another horse, the aggressor may be disqualified, unless the impeding horse or his jockey was partly in fault or the jostle was wholly caused by the fault of some other horse or jockey.
